Landlord Licence Variation
Landlord Licence Variation enables licence holders, managers or other relevant persons to vary the terms of a licence that is in force for a house, flat or house in multiple occupation in the designated licence areas within Stockton.
A licence can only be varied once it has come into force so, if you are still in the process of applying for a licence and want to change some details on your application, please contact SelectiveLicensing@Stockton.gov.uk.
You must not change the way you occupy or use the property unless the Council has made a decision to vary the licence. For example, if you are applying to increase the maximum occupancy, you should not let the extra places until the licence has been varied to permit these extra people.
Examples of things that you can apply to vary include:
- the details of the new or existing managers, including changes of address
- the maximum number of persons or household on a licence
- the address or contact details for the licence holder
- the conditions on the licence i.e. where works have been completed
- the expiry date of the licence (only applicable in specific situations
For some of these it will be necessary to provide supporting documentation for example updated plans when works have been completed.
A licence can never legally be transferred to another person or between properties. As such, any applications to vary either of these details will be refused.
After considering the application, the Council will make a decision to either vary or refuse to vary the licence. Usually, the Council will serve a notice proposing a particular course of action and giving the interested parties a chance to make representations, before proceeding to a final decision.
However, where it is agreed with the licence holder, the Council can sometimes go straight to a decision to vary the licence. If your query to vary is urgent please highlight this in your request to vary.
There are no fees or charges for applying to vary a licence.
